Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Irie Commerce platform ("Platform") and is incorporated into our Terms of Service. By using the Platform, you agree to comply with this policy. Violations may result in content removal, account suspension, or termination.
1. Permitted Uses
The Irie Commerce platform is designed for merchants selling legitimate products and services. The following uses are permitted and encouraged:
- Sale of lawful goods that comply with all applicable local, state, federal, and international laws and regulations.
- Sale of original designs, artwork, and creative works that you have created or for which you hold all necessary rights.
- Sale of officially licensed merchandise where you hold a valid, verifiable license agreement with the intellectual property owner.
- Print-on-demand products featuring designs that you have created or for which you hold all necessary usage rights and licenses.
- Handmade, artisan, and custom products produced by you or your business.
- Resale of goods where you have legitimate authorization from the manufacturer or distributor.
2. Prohibited Uses
The following activities are strictly prohibited on the Irie Commerce platform. Any merchant found engaging in these activities is subject to immediate content removal, account suspension, or permanent termination:
Counterfeit and Infringing Products
- Counterfeit goods, knockoffs, or replicas of trademarked products, regardless of whether they are labeled as "inspired by," "style of," or similar designations.
- Products that infringe on any third-party intellectual property rights, including copyrights, trademarks, patents, or trade dress.
- Unlicensed branded merchandise bearing the names, logos, images, or likenesses of brands, companies, sports teams, universities, or entertainment properties without valid written authorization.
- Products featuring the likeness, name, signature, or image of any celebrity, athlete, public figure, or private individual without their express written authorization.
Illegal Products and Activities
- Products that are illegal to manufacture, sell, or distribute under any applicable law.
- Controlled substances, drug paraphernalia, or products intended to facilitate illegal drug use.
- Weapons, explosives, or products designed to cause harm.
- Stolen goods or goods obtained through illegal means.
Deceptive Practices
- Products with false, misleading, or unsubstantiated health, safety, or performance claims.
- Misrepresentation of product origin, materials, certifications, or characteristics.
- Bait-and-switch tactics, including advertising products that differ materially from what is delivered to the customer.
- Fraudulent business practices, including fake reviews, manufactured testimonials, or deceptive marketing.
- Impersonation of other businesses, brands, or individuals.
3. DMCA Takedown Process
Irie Commerce respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on the Platform infringes your copyright, you may submit a DMCA takedown notice to our designated agent.
To submit a valid DMCA notice, send a written communication to [email protected] that includes all of the following:
- Identification of the copyrighted work. A description of the copyrighted work that you claim has been infringed, including the registration number if available.
- Identification of the infringing material. A description of the material you claim is infringing and its location on the Platform, with sufficient detail for us to locate it (e.g., URLs or store names).
- Your contact information. Your full legal name, mailing address, telephone number, and email address.
- Good faith statement. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- Perjury statement. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
- Signature. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Upon receipt of a valid DMCA notice, we will promptly investigate the claim and take appropriate action, which may include removing or disabling access to the allegedly infringing material. We will notify the affected merchant and provide them with an opportunity to submit a counter-notification if they believe the takedown was made in error.
4. Enforcement
Irie Commerce reserves the right to enforce this Acceptable Use Policy at its sole discretion. Enforcement actions may include, but are not limited to:
- Content removal. Immediate removal of products, listings, images, or other content that violates this policy.
- Account suspension. Temporary suspension of your account and store while a violation is under review.
- Account termination. Permanent termination of your account for severe or repeated violations.
- Legal action. Referral of violations to appropriate law enforcement authorities and pursuit of legal remedies as necessary.
We may take enforcement action without prior notice where we reasonably believe that a violation poses an immediate risk of harm, legal liability, or reputational damage to Irie Commerce or its users.
5. Reporting Violations
If you become aware of any content or activity on the Platform that you believe violates this Acceptable Use Policy, please report it to us at [email protected]. Include as much detail as possible, including the store name, product URLs, and the nature of the violation. We review all reports and take appropriate action in accordance with this policy.
6. Changes to This Policy
We may update this Acceptable Use Policy from time to time. If we make material changes, we will notify you via email at the address associated with your account. Your continued use of the Platform after notification constitutes your acceptance of the updated policy.
